What Can You Do Now?
1. Submit written comments before Monday, August 31 at 5:00 p.m.
Comments go to Sean Curtis, Planning Director, at seancurtis@co.modoc.ca.us or by mail to: 203 West 4th Street, Alturas, CA 96101.
Comments need to raise specific concerns, not just general opposition.
Reference specific items in the MND. Pick one or two things you know or care about (like water use, road traffic, noise, dust, wildlife, agricultural land, tribal history) and describe it specifically, even in a few sentences. Personal knowledge or experience counts as evidence.Ask directly for a full EIR, not just changes to the MND.
Explicitly ask: "I request that the County prepare a full Environmental Impact Report rather than adopt a Mitigated Negative Declaration for this project."Ask the County to confirm receipt of comments in writing.
This creates a paper trail proving the comment was timely submitted.
2. Spread the Word! Encourage anyone with relevant expertise or lived experience to comment directly.
A well driller, a former county employee, a rancher with generational knowledge of water levels, or a hunter familiar with wildlife corridors — testimony like this can carry real evidentiary weight under CEQA's "fair argument" standard, which only requires substantial evidence that a significant impact is possible, not proof beyond doubt.
3. Show up and speak at the Planning Commission hearing, once scheduled.
Spoken public comment at the hearing becomes part of the official record too, in addition to written comments submitted beforehand.
4. Stay engaged after August 31 and help fundraise for the War Chest!
If the County adopts the MND anyway, there's a further 30-day window to legally challenge it, and continued public pressure and turnout at hearings still matters throughout that process.
